The large extent of illicit file swapping through the internet enabled by peer to peer networks has caused the copyright industry to try a number of strategies in order to limit the financial losses it has incurred. With a view to examine whether the European legal regime is adequate for the protection of copyright and related rights, this thesis shall assess the special position of Internet Service Providers in the fight against piracy as they are inevitably caught between right holders and infringers. Picking and choosing among the most controversial issues and interesting case law of the Court of Justice of the European Union the dissertation shall examine the recent developments pertaining to the position of the public interest when copyright protection and the protection of privacy, personal data and secrecy of communications clashes, and will further delineate the boundaries of copyright protection when balanced against other fundamental rights
