Ποια ή με ποιες λειτουργίες εκπληρώνει ένα έγγραφο σε σχέση με το δικαίωμα εξαρτάται από την αποστολή την οποία καλείται να επιτελέσει το συγκεκριμένο έγγραφο στις συναλλαγές. Σχετικά γίνεται διάκριση μεταξύ εγγράφων αποδεικτικών, συστατικών, νομιμοποιητικών και αξιόγραφων.\nΤα αξιόγραφα είναι θεσμός του σύγχρονου δικαίου. Αναπτύχθηκαν από την εποχή που επινοήθηκε η ρήτρα “σε διαταγή”.\nΓια το Ελληνικό δίκαιο σκόπιμη είναι η διάκριση μεταξύ αξιόγραφου υπό ευρεία και υπό στενή έννοια:\nΥπό ευρεία έννοια, είναι το έγγραφο, με το οποίο συνδέεται ένα δικαίωμα κατά τέτοια τρόπο, ώστε η κατοχή του εγγράφου να είναι απαραίτητη για την άσκηση του δικαιώματος.\nΥπό στενή έννοια, έγγραφα δηλαδή για τα οποία η κατοχή του εγγράφου είναι απαραίτητη όχι μόνο για την ενάσκηση αλλά και για την μεταβίβαση του δικαιώματος.",
