      "@value" : "Αντικείμενο της εργασίας αποτελεί η εξαίρεση και η αυτοεξαίρεση των δικαστικών προσώπων και ιδίως των δικαστών στην πολιτική και στην ποινική δίκη. \nΤο πρώτο μέρος της εργασίας πραγματεύεται την αρχή της δικαστικής αμεροληψίας, πραγμάτωση της οποίας αποτελεί ο θεσμός της εξαίρεσης. Ειδικότερα, επιχειρείται ο προσδιορισμός της σχετικής έννοιας και εξετάζεται η σχέση της με τις αρχές της δικαστικής ανεξαρτησίας και του φυσικού δικαστή. Περαιτέρω, αναλύονται τα συνταγματικά και υπερνομοθετικά θεμέλια της αρχής της δικαστικής αμεροληψίας, με ιδιαίτερη έμφαση στην ανάλυση της νομολογίας του ΕΔΔΑ. \nΣτο δεύτερο μέρος εκτίθενται οι σχετικές με την εξαίρεση του δικαστικού προσώπου ρυθμίσεις του ΚΠολΔ και του ΚΠΔ κατά τρόπο συγκριτικό και συστηματοποιημένο έτσι ώστε να σκιαγραφηθεί μία ενιαία εικόνα του ζητήματος της εξαίρεσης στο πλαίσιο του εγχώριου δικαιοδοτικού συστήματος. Εν συνεχεία, αναλύονται διεξοδικά οι προβλεπόμενοι στον ΚΠολΔ και στον ΚΠΔ λόγοι εξαίρεσης συστηματοποιημένοι σε τέσσερεις μεγάλες κατηγορίες. Περαιτέρω, αναπτύσσονται τα δικονομικά ζητήματα της εξαίρεσης, τόσο στην περίπτωση η διαδικασία κινείται με αίτημα του διαδίκου, όσο και στην περίπτωση που το ίδιο το δικαστικό πρόσωπο υποβάλλει αίτηση αυτοεξαίρεσης.  \nΤέλος, εκτίθενται κάποιες συμπερασματικές παρατηρήσεις σχετικά με το δυσεπίλυτο του προβλήματος της εξαίρεσης στην περίπτωση της διαδοχικής άσκησης δικαιοδοτικών καθηκόντων επί του ίδιου βιοτικού συμβάντος."

      "@value" : "The subject of the paper is the judicial disqualification and recusal of judicial persons, especially judges in civil and criminal proceedings.\nThe first part of the paper discusses the principle of judicial impartiality, the realization of which is the institution of judicial disqualification. In particular, an attempt is made to determine the relevant concept and examine its relationship with the principles of judicial independence and natural justice. Furthermore, the constitutional and supra-legislative foundations of the principle of judicial impartiality are analyzed, with particular emphasis on the analysis of ECHR jurisprudence.\nIn the second part, the provisions of the Civil Procedural Code and the Criminal Procedural Code related to the exception of the judicial person are set out in a comparative and systematic way in order to outline a single picture of the subject of judicial disqualification in the context of the domestic judicial system. Subsequently, the grounds for judicial disqualification provided for in the Civil Procedural Code and the Criminal Procedural Code are thoroughly analyzed and systematized into four major categories.  Moreover, the procedural issues of judicial disqualification are presented, both in the case where the procedure is initiated at the request of the party, and in the case where the judicial person himself submits a request for recusal.\nFinally, some concluding observations are presented regarding the intractability of the problem of judicial exclusion in the case of the successive exercise of jurisdictional duties on the same factual event."
