Αντωνακάκη ΑντωνίαAntonakaki AntoniaH παρούσα εργασία καταπιάνεται με την αναλογία μεταξύ του λογοτεχνικού έργου τέχνης και του δικαίου στην σκέψη του Ronald Dworkin. Αναζητώντας να αναδείξει τον ερμηνευτικό χαρακτήρα του δικαίου, ο Dworkin στρέφεται στην πρακτική της λογοτεχνικής κριτικής ως πρακτική που συνδυάζει περιγραφικά και αξιολογικά στοιχεία. Αποκορύφωμα της σκέψης αυτής αποτελεί η ιδέα πως το δίκαιο αποτελεί αλυσιδωτό μυθιστόρημα, που έγινε γνωστή από το έργο του "Η Αυτοκρατορία του Νόμου". Στόχος της εργασίας είναι αφενός να παρουσιάσει την αναλογία μεταξύ έργου τέχνης και δικαίου, όπως την κατασκευάζει ο Dworkin, και αφετέρου να την αποτιμήσει κριτικά, εξετάζοντας την πρώτα από την πλευρά της λογοτεχνίας και ύστερα από την πλευρά του δικαίου. Η αναλογία, ισχυρίζομαι, παρά την ελκυστικότητά της, πάσχει στα θεμέλιά της, καταλήγοντας να πρόκειται για μια μεταφορά, με σημαντικά μειωμένη γνωσιολογική σημασία για την θεωρία του Dworkin.This paper deals with the analogy between the literary work of art and law in the thought of Ronald Dworkin. Seeking to highlight the hermeneutic character of law, Dworkin turns to the practice of literary criticism as a practice that combines descriptive and evaluative elements. The culmination of this thinking is the idea that law is a chain novel, made famous by his work "Law's Empire".
