Στεφανακίδη Άννα-ΜαρίαStefanakidi Anna-MariaΣκοπός της παρούσας εκπονηθείσας εργασίας είναι η εξέταση των παραμέτρων που προκύπτουν από τη συνύπαρξη της αρχής της διαφάνειας με την αρχή του ανταγωνισμού υπό το πρίσμα της αρχής της εμπιστευτικότητας των πληροφοριών που τίθενται στο πλαίσιο της διαγωνιστικής διαδικασίας ενώπιον της αναθέτουσας αρχής, κατά την διαδικασία επιλογής του αναδόχου. Περαιτέρω, εξετάζονται τα κύρια σημεία της αρχής της διαφάνειας και της αρχής του ανταγωνισμού καθώς και η διαδικασία ενσωμάτωσής τους από το ενωσιακό δίκαιο στην ελληνική έννομη τάξη. Ταυτόχρονα, επισημαίνονται κρίσιμα ζητήματα για τον εμπιστευτικό χαρακτήρα των πληροφοριών που διαβιβάζουν οι οικονομικοί φορείς στις αναθέτουσες αρχές. Επιπροσθέτως, επιχειρείται ένταξη των κριτηρίων ESG στην έννοια της εμπιστευτικής πληροφορίας που προστατεύεται στον Ν. 4412/2016 «Δημόσιες Συμβάσεις Έργων, Προμηθειών και Υπηρεσιών». Τέλος, εξετάζεται η αναλογική εφαρμογή της διαιτησίας ως εναλλακτική μορφή παροχής δικαστικής προστασίας.The purpose of this thesis is to examine the parameters arising from the coexistence of the principle of transparency with the principle of competition in the light of the principle of confidentiality of information provided during the tender process before the contracting authority, during the contractor selection process. Additionally, the main points of the principle of transparency and the principle of competition are examined as well as the process of their integration from EU law into the Greek legal order. Furthermore, critical issues regarding the confidential nature of information provided by economic operators to the contracting authorities are highlighted. In addition, an attempt is made to integrate ESG criteria into the concept of confidential information protected in Law 4412/2016 “Public Contracts for Works, Supplies and Services”.
