Αρχικά, σε πρώτο επίπεδο, επιδιώκεται η ανάλυση των βασικών εννοιών και των αντιτιθέμενων συμφερόντων των μερών, η παρουσίαση του βασικού μοντέλου προστασίας, όπως αυτό ίσχυε μέχρι το 2019, βασιζόμενο στα νομολογιακά διαπλασθέντα κριτήρια στάθμισης του ΕΔΔΑ και τέλος η ανάλυση των βασικών ρυθμίσεων της Οδηγίας 2019/1937, και κατ'επέκταση του εθνικού νόμου 4990/2022. Στη συνέχεια, σε ένα δεύτερο επίπεδο, προχωρήσαμε σε μια συγκριτική επισκόπηση αφενός του επιπέδου προστασίας που παρείχετο μέσω του ΕΔΔΑ και της προστασίας που διασφαλίζει η Οδηγία στους μάρτυρες δημοσίου συμφέροντος, προκειμένου να εξετάσουμε ποιο σύστημα κρίνεται αποτελεσματικότερο και αφετέρου στη σύγκριση του εθνικού συστήματος με το γαλλικό, μετά τις τροποποιήσεις που υπέστησαν το 2022, συμμορφούμενα προς τις επιταγές της Ενωσιακής Οδηγίας. Τέλος, στόχος μας ήταν να αναδείξουμε, όσο το δυνατό σφαιρικότερα, το θεσμό του μάρτυρα δημοσίου συμφέροντος, τα κενά της νομοθεσίας, τα οφέλη και τα πιθανά προβλήματα που θα εμφανιστούν από την εφαρμογή του στην πράξη.The paper refers to the institution of the employee whistleblower. Initially, at the first level, the analysis of the basic concepts and the opposing interests of the parties, the presentation of the basic model of protection, as it was in force until 2019, based on the jurisprudentially developed weighting criteria of the ECtHR and finally the analysis of the basic provisions of Directive 2019/1937, and by extension of the national law 4990/2022. Then, at a second level, we proceeded to a comparative review of the level of protection provided by the ECtHR and the protection guaranteed by the Directive to whistleblowers, in order to examine which system is considered more effective and to compare the national system with the French system, after the amendments made in 2022, in order to comply with the requirements of the EU Directive.
