Μίχου ΠαναγιώταMichou PanagiotaΗ παρούσα διπλωματική εργασία εξετάζει το εύρος της προστασίας του δικαιώματος στην άμβλωση, μέσα από τη συγκριτική επισκόπηση της συνταγματικής προστασίας στις έννομες τάξεις της Ελλάδας, της Γερμανίας και των Ηνωμένων Πολιτειών της Αμερικής. Για τον σκοπό αυτό, αναλύονται τόσο τα συμφυή συνταγματικά δικαιώματα της ενήλικης γυναίκας, όσο και οι σημαντικότερες δικαστικές αποφάσεις που έχουν διαμορφώσει το δίκαιο της άμβλωσης στη Γερμανία και στις ΗΠΑ μέσω των αντίστοιχων Συνταγματικών Δικαστηρίων, περιλαμβανομένης της απόφασης Dobbs v. Jackson Women's Health Organization η οποία επέφερε μία συθέμελη ανατροπή της αναγνώρισης του δικαιώματος στην άμβλωση ως θεμελιώδους ανθρώπινου δικαιώματος στις ΗΠΑ. Τέλος, εντοπίζονται και αναλύονται οι αδυναμίες της νομολογίας που έχουν οδηγήσει σε ένα έλλειμμα προστασίας στις ως άνω αναφερόμενες αλλοδαπές έννομες τάξεις, ώστε να καθίσταται αναγκαία όχι μόνο η πληρέστερη συνταγματική προστασία των γυναικών, αλλά και η προσπάθεια επίτευξης ουσιαστικής ισότητας και αναπαραγωγικής δικαιοσύνης.The present thesis aims to examine the scope of protection of the right to an abortion through a comparative overview of the constitutional protection under Greek, German and the United States law. To this end, both the inherent constitutional rights of adult women, as well as the landmark decisions that have shaped the law of abortion in Germany and the USA through their respective Constitutional Courts are analyzed, including the case of Dobbs v. Jackson Women's Health Organization which overturned the status of the right to an abortion as a fundamental human right in the US.
