Εξάρχου ΣοφίαExarchou SofiaΗ παρούσα μελέτη οριοθετεί αρχικώς το πλαίσιο αναφοράς του όρου κοινωνικά δικαιώματα στο σύγχρονο κοινωνικό κράτος δικαίου. Εν συνεχεία, επιχειρεί να αποδελτιώσει με τη μεγαλύτερη δυνατή πληρότητα και κριτική διάθεση τις υφιστάμενες τάσεις στην θεωρία και τη νομολογία περί τη δεσμευτικότητα των ως άνω δικαιωμάτων και των μορφών που αυτή αναπτύσσει έναντι της διοικήσεως, του νομοθέτη αλλά και της δικαστικής εξουσίας. Απώτερος δε σκοπός των ανωτέρω καταγραφών και συλλογισμών καθίσταται η εξαγωγή κρίσιμων και χρήσιμων προς τον μελλοντικό μελετητή συμπερασμάτων αναφορικά με την πραγματική διασφάλιση της ανθρώπινης υπόστασης ως αυταξίας στο σήμερα, δια μέσου των κοινωνικών δικαιωμάτων.The present study firstly defines the frame of reference of the term social rights in the modern welfare state under the rule of law. Subsequently, it tries to review with the greatest possible completeness and critical disposition the existing trends in theory and jurisprudence concerning the binding nature of the aforementioned rights and the forms under which it evolves vis-à-vis the administrative, legislative and judicial power.
