Το Κράτος μη δυνάμενο να ανταπεξέλθει πλέον επαρκώς στις ολοένα αυξανόμενες απαιτήσεις που δημιουργούνται καθημερινά, αναζητά νέους τρόπους οργάνωσης και δράσης, μέσω των οποίων θα μπορέσει να εκπληρώσει τις υποχρεώσεις που έχει αναλάβει έναντι των πολιτών του. Χαρακτηριστικό αυτού αποτελεί η μετατόπιση ή άλλως η μετάλλαξη του τρόπου διακυβέρνησης που μέχρι πρότινος γνωρίζαμε μεταξύ Κράτους και διοικουμένων. Το φαινόμενο αυτό είναι γνωστό με τον όρο «συμβασιοποίηση του δημοσίου δικαίου». Αυτή συνίσταται στην μεταστροφή του τρόπου άσκησης της δημόσιας διοίκησης, δηλαδή το πέρασμα από μία διακυβέρνηση με βάση τον νόμο, σε μία διακυβέρνηση στηριζόμενη στην σύμβαση και ερειδόμενη κατά κύριο λόγο σε σχέσεις με βάση τη συναίνεση, τους δεσμούς πίστης και της αλληλεξάρτησης διοίκησης - διοικουμένου.In the modern era that we are going through, a change is observed in the way of action of the public administration. The State, no longer able to cope adequately with the ever-increasing demands that are constantly being created, is looking for new ways of organization and action, through which it will be able to fulfill the obligations it has undertaken towards its citizens. Characteristic of this is the shift or in other words the mutation of the mode of governance that we knew until now between the State and the governed.
