Βαφειάδης ΘεοδόσιοςVafeiadis TheodosiosΗ τέλεση τελετουργικών σφαγών συνδέεται με σύνθετα φιλοσοφικά, δικαιικά και πολιτικά διλήμματα. Τα τελευταία έτη αναπτύσσεται δε ένας συναισθηματικά φορτισμένος διάλογος, με σημείο αιχμής τη θεσμοθέτηση ενός καθολικού κανόνα αναισθησίας των παραγωγικών ζώων πριν τη θανάτωσή τους. Διχαστικός λόγος και «άβολα» εκατέρωθεν επιχειρήματα, χαρακτηρίζουν τη διαφωνία, όσων υποστηρίζουν ότι η προαγωγή της καλής διαβίωσης των ζώων, επιτάσσει την απαγόρευση ή αυστηρό περιορισμό της τέλεσης σφαγών λατρευτικού τύπου και όσων υπερμάχονται του δικαιώματος θρησκευτικών ομάδων να τηρούν διατροφικούς κανόνες που επιβάλλει η πίστη τους. Η παρούσα εργασία διερευνά μερικά από τα πολυδιάστατα νομικά, θρησκευτικά και φιλοσοφικά ζητήματα που σχετίζονται με την ως άνω πρακτική. Σκιαγραφώντας τις τελετουργικές σφαγές και τη θρησκευτική βάση αυτών, τις προστατευτικές τις θρησκευτικές ελευθερίας διατάξεις, τη σχετική νομοθεσία θανάτωσης παραγωγικών ζώων, την επιχειρηματολογία που έχει αναπτυχθεί από διεθνή και εθνικά δικαστήρια επί του ζητήματος, τα σχετικά επιστημονικά πορίσματα, αλλά και διερευνώντας τις πολιτικές παραμέτρους του ζητήματος, θα επιχειρηθεί να σταθμιστεί το εύρος του επιτρεπτού ενός μέτρου περιορισμού της θρησκευτικής ελευθερίας με σκοπό την προαγωγή της καλής διαβίωσης των ζώων στο πλαίσιο μιας ανομοιογενούς, ανεκτικής, δημοκρατικής Ευρώπης.The practice of ritual slaughter is associated with complex philosophical, legal and political dilemmas. In recent years, an emotionally charged dialogue has been developing, with the peak point being the establishment of a universal rule of anesthesia for productive animals before their slaughter. Divisive speech and "uncomfortable" arguments on both sides characterize the disagreement, of those who argue that the promotion of animal welfare requires the prohibition or strict limitation of cult-type slaughter and of those who fight for the right of religious groups to observe dietary rules imposed by their faith. This paper explores some of the multidimensional legal, religious and philosophical issues associated with the above practice.
