Ο πειραματισμός στην ιατρική πράξη για την ανακάλυψη θεραπευτικών μεθόδων και ιδίως νέων φαρμάκων, απαιτεί κλινικές δοκιμές που περιλαμβάνουν μεταξύ άλλων και το πρόσωπο. Στο ευρύτερο πλαίσιο των ηθικών προβληματισμών που γεννώνται, περιλαμβάνονται και βιοηθικά ζητήματα που άπτονται στην αρχή της δικαιοσύνης. Σκιαγραφώντας το γενικό πλαίσιο έκφρασης της αρχής της (διανεμητικής) δικαιοσύνης στην έρευνα και ειδικότερα στο πεδίο των κλινικών δοκιμών, επικεντρωνόμαστε στην (ίση) πρόσβαση στην έρευνα, την συμμετοχή ή μη σε αυτήν ευάλωτων κοινωνικών ομάδων, όπως οι έγκυες, τα παιδιά και άλλοι (πχ. άνεργοι, ηλικιωμένοι) και στη δίκαιη κατανομή των βαρών και των ωφελημάτων της. Τέλος, διερευνάται η νομική ρύθ-μιση και η ηθική αξιολόγηση της στρατολόγησης των συμμετεχόντων στις κλινικές δοκιμές, και το ειδικότερο ζήτημα αν η συμμετοχή αυτή συμβαδίζει με την σκοπιά της Ρωλσιανής αντίληψης για την δικαιοσύνη ως ακριβοδικία όταν λαμβάνει χώρα έναντι χρηματικών ή άλλων ανταλλαγμάτων.

Experimentation in medical practice for the discovery of therapeutic methods and in particular new drugs requires clinical trials involving, among others, the person. In the broader context of the ethical considerations that arise, bioethical issues relating to the principle of justice are also included. In outlining the general framework for the expression of the principle of (distributive) justice in research and in the field of clinical trials in particular, we focus on (equal) access to research, the participation or non-participation of vulnerable social groups such as pregnant women, children and others (e.g. unemployed, elderly) and the fair distribution of its burdens and benefits. Finally, the legal regulation and ethical evaluation of the recruitment of participants in clinical trials is explored, and the specific issue of whether such participation is consistent with the perspective of the Rawls conception of Justice as Fairness when it takes place in exchange for money or other exchanges.
