Η παρούσα διατριβή έχει ως αντικείμενο τη διαμεσολάβηση αστικών και εμπορικών διαφορών. Σκοπός της είναι η παρουσίαση του θεσμού της διαμεσολάβησης, αρχικώς, στην έννομη τάξη των Η.Π.Α («κοιτίδα» της διαμεσολάβησης) και εν συνεχεία με «ε φ α λ τ ή ρ ι ο» τις κοινοτικές πρωτοβουλίες - με προεξέχουσα την Οδηγία 2008/52/Ε.Κ - στην ελληνική, αγγλική, γαλλική, ιταλική και γερμανική έννομη τάξη. Απώτερος στόχος είναι η αξιοποίηση των προβληματισμών που θα γεννηθούν για ένα ακόμη καλύτερο σύστημα διαμεσολάβησης. Για τη διευκόλυνση του αναγνώστη ο τρόπος παρουσίασης σε κάθε έννομη τάξη είναι παρεμφερής. Για κάθε έννομη τάξη αφιερώνεται ξεχωριστό «ΜΕΡΟΣ». Η διατριβή ολοκληρώνεται με κάποιες συγκριτικές και συμπερασματικές παρατηρήσεις σε βασικά (κατά την άποψη του γράφοντος) ζητήματα.
This thesis deals with the mediation of civil and commercial disputes in a wide range of countries. The purpose is to present the institution of mediation, initially, in the US legal order (“cradle” of mediation), and subsequently to "Community initiatives" - with the outset of Directive 2008/52 / EC - in the Greek, English, French, Italian and German legal systems. The ultimate goal is to exploit the concerns that will arise for an even better mediation system. In order to facilitate the reader, the way of presentation in each legal order is similar. For each legal class, a separate "PART" is dedicated. The thesis is completed with some comparative and concluding remarks on the main issues (in the opinion of the writer).
