Δεδομένων των εξελίξεων στην ιατρική επιστήμη και την τεχνολογία, η τεχνητή αναπαραγωγή αποτελεί καταφύγιο για τα ενδιαφερόμενα πρόσωπα να αποκτήσουν απογόνους όταν αντιμετωπίζουν ζητήματα τεκνοποιίας. Η ετερόλογη τεχνητή γονιμοποίηση συνίσταται στη χρήση γεννητικού υλικού τρίτου δότη, ξένου σε σχέση με τα ενδιαφερόμενα πρόσωπα να τεκνοποιήσουν. Λόγω των ηθικών ζητημάτων που αναμφισβήτητα ανακύπτουν και του συγγενικού δεσμού που ιδρύεται ανάμεσα στα εμπλεκόμενα πρόσωπα, τέθηκαν αυστηρές προϋποθέσεις από τον νομοθέτη, θετικές και αρνητικές, προκειμένου να κατοχυρωθεί η διαδικασία της ετερόλογης τεχνητής αναπαραγωγής, με αποτέλεσμα, όταν αυτές παραβιάζονται, ο γιατρός να υπέχει και αστικής ευθύνης. Given the medical science and technology progress, in vitro fertilization constitutes a shelter for those concerned to obtain children when dealing with childbirth issues. Heterologous in vitro fertilization involves the use of third-party genital material, other than the genital material of the concerned persons to obtain children. Due to the ethical issues that undoubtedly arise and the kinship that is established between the persons involved, the legislator has imposed strict prerequisites, both positive and negative, in order to safeguard the process of the heterologous in vitro fertilization, and as a result the physician is liable for civil liability when these prerequisites are violated.
