Διερευνάται η ευθύνη της ΕΕ απέναντι σε ιδιώτες, η οποία ενδεχομένως ανακύπτει λόγω πράξεων στον τομέα της ΚΕΠΠΑ, διά των οποίων επιβάλλονται σε ιδιώτες "έξυπνες κυρώσεις". Εξαιτίας του ιδαίτερου χαρακτήρα της ΚΕΠΠΑ, το ΔΕΕ έχει περιορισμένο ρόλο στον συγκεκριμένο τομέα. Ελλείψει ρητών διατάξεων και ενόψει επακόλουθων κενών, ιδιαίτερα σημαντική καθίσταται η νομολογία του ΔΕΕ σχετικά με τη δικαιοδοσία του, την οποία θεμελιώνει σε βασικές αρχές της ΕΕ. Πρόκεται, εντούτοις, για στέρεες ή σαθρές δικαιολογητικές βάσεις; (EL)
EU liability towards individuals, which may arise from acts in the CFSP area that impose "smart sanctions" on individuals, is investigated. Due to the specific nature of the CFSP, the CJEU has a limited role in this sector. In the absence of explicit provisions and due to subsequent gaps, the case law of the CJEU on its jurisdiction, which is based on fundamental EU principles, becomes particularly important. However, are the legal bases solid or flimsy? (EN)
