Με την παρούσα εργασία επιχειρείται να αναλυθεί το ζήτημα της προστασίας του διοικουμένου σε περιπτώσεις μη συμμόρφωσης της Διοίκησης στις ακυρωτικές δικαστικές αποφάσεις, κατ' εφαρμογήν του εκτελεστικού του Συντάγματος ν. 3068/2002 και του π.δ. 61/2004, μέσω καταγραφής θεωρητικών απόψεων αλλά και νομολογιακών δεδομένων, και δη δικαστικών αποφάσεων που άπτονται της ακυρωτικής αρμοδιότητας του Συμβουλίου της Επικρατείας και του Διοικητικού Εφετείου καθώς και αποφάσεων των Τριμελών Συμβουλίων Συμμόρφωσης των διοικητικών δικαστηρίων και του Ευρωπαϊκού Δικαστηρίου Δικαιωμάτων του Ανθρώπου. The present dissertation aims to analyze the issue of the citizen's protection in case of non-compliance of the Administration with an annulment judgment of the administrative courts, pursuant to the executive of the Constitution Law 3068/2002 and the presidential decree no. 61/2004, through the recording of theoretical opinions as well as jurisprudential data (case law), and in particular judicial decisions concerning the annulment competence of the Council of State and the Administrative Court of Appeal as well as decisions of the Tripartite Compliance Boards of the administrative courts and the European Court of Human Rights.
