Ένας λογογράφος, ο οποίος απασχόλησε τόσο τους ιστορικούς και τους φιλολόγους όσο και τους νομικούς κατά τους προηγούμενους αιώνες υπήρξε ο Ισαίος. Οι δικανικοί λόγοι του Ισαίου, ναι μεν αποτελούν πλούσιο πηγαίο υλικό για το κληρονομικό δίκαιο της αρχαίας Αθήνας, αλλά ένα βασικό γνώρισμά τους είναι ότι έχουν μελετηθεί κυρίαρχα από φιλολόγους, ιστορικούς και γλωσσολόγους με έμφαση στις γλωσσικές ιδιαιτερότητες των λόγων, στα χρησιμοποιούμενα εκεί γλωσσικά σχήματα και στην παρατιθέμενη επιχειρηματολογία. Το στοιχείο το οποίο έλειπε, είναι η προσέγγιση των λόγων αυτών εξ απόψεως της ιστορίας του δικαίου με στόχο την ανάδειξη του δικαίου της κληρονομικής διαδοχής της αρχαίας Αθήνας, τόσο της εξ αδιαθέτου όσο και της εκ διαθήκης. Η παρούσα διδακτορική διατριβή έχει αυτόν τον στόχο. Επιχειρεί να διεισδύσει στους λόγους του Ισαίου και να αναδείξει το δίκαιο της εξ αδιαθέτου και της εκ διαθήκης κληρονομικής διαδοχής. Προβάλλει το κληρονομικό δίκαιο της αρχαία Αθήνας μέσα από πολλαπλά χωρία των λόγων του Ισαίου (την κατεξοχήν πηγή της κληρονομικής διαδοχής τον 4ο αιώνα π.Χ. στην αρχαία Αθήνα) και δευτερευόντως μέσα από χωρία των λόγων του Δημοσθένη. Δηλαδή, ενώ στις άλλες μελέτες αφετηρία αποτέλεσε το πηγαίο υλικό των λόγων του Ισαίου και στόχος υπήρξε η γλωσσική, μεταφραστική και ερμηνευτική προσέγγιση αυτών, στην παρούσα διδακτορική διατριβή η αφετηρία υπήρξε σαφώς κοινή, αλλά στόχος ήταν η παρουσίαση της κληρονομικής νομοθεσίας του 4ο αιώνα π.Χ. και η αποσαφήνιση ποικίλων νομικών προβλημάτων που άπτονταν της κληρονομικής διαδοχής. This dissertation was submitted at the law school of Democriteion University of Thrace in Komotini Greece on the 4th July 2012 and is titled: «The law of succession in ancient Athens in the 4th century B.C. according to the speeches of Isaeus». Isaeus was a well-known orator who lived in Athens in 4th century B.C. and his speeches are related to inheritance cases. Taking into account the fact that these speeches were mostly researched through a linguistic scope, the interest of this dissertation’s writer was to examine this unique source through a legal scope, in an attempt to bring light to the law of succession that existed during the aforementioned period. It is clear that apart from the laws themselves, the reader of this dissertation is also going to be aware of the social status of the Athenian society in the 4th century B.C. The dissertation is divided into seven units. The first unit is dedicated to the «οἶκος» which is the most fundamental and essential unit of the city of Athens at that time and to its role to succession. The second unit is about the distinction of two verbs «δίδωμι» and «διατίθεμαι». The third chapter is dedicated to the distinction of five nouns which were used extensively within the speeches of Isaeus. These nouns were «οὐσία», «ὄντα», «χρήματα», «κλῆρος» and «κληρονομία». The fourth unit is about the adoption in ancient Athens and the link that existed between the adoption and the succession in ancient Athens. The fifth unit is about the intestate law of succession while the sixth unit is dedicated to the testamentary law of succession. The seventh chapter is about the ways that heirs defended themselves using the appropriate means in Athenian courts as far as the inheritance cases were concerned. Last but not least, there is a final chapter which is consisted of the main conclusions of the research as well as the vital points that made the whole research be innovative. […]
