Σκοπός της διατριβής ήταν η παρουσίαση και μελέτη του Συντονιστικού Κανονισμού με επίκεντρο την συνταξιοδοτική προστασία. Ως εκ τούτου, επιλέχθηκε η συστηματοποιημένη ανάλυση του Συντονιστικού Κανονισμού και η σκιαγράφηση των αλλαγών που έχουν επέλθει υπό το καθεστώς του νέου Συντονιστικού Κανονισμού 883/04, σε αντιπαραβολή με τον προηγούμενο (παλαιό Κανονισμό 1408/71), προκειμένου να αποτυπώσουμε την παρεχόμενη προστασία, τα τυχόν υφιστάμενα κενά και την εφαρμογή του Κανονισμού εν γένει και ειδικότερα σε σχέση με τις συντάξεις. Εκκινούμε από τις γενικές διατάξεις (Τίτλος Ι) και εν συνεχεία εξετάζουμε τους κανόνες προσδιορισμού της εφαρμοστέας νομοθεσίας (Τίτλος ΙΙ), προκειμένου να υπεισέλθουμε στην κριτική παρουσίαση όλων των ειδικών διατάξεων που αφορούν τις συντάξεις και τους συνταξιούχους (Τίτλος ΙΙΙ). Τα πολυποίκιλα ζητήματα που προκύπτουν από την εφαρμογή του Κανονισμού αναλύονται σε βάθος. Η παρουσίαση των κανόνων συντονισμού μέσα από την αναπόφευκτη σύγκριση μεταξύ του παλαιού και του νέου Κανονισμού εμπλουτίζεται από τη σχετική αρθρογραφία και βιβλιογραφία, τη νομολογία του Δικαστηρίου της ΕΕ, σχετικές πράξεις των ευρωπαϊκών οργάνων, αλλά και τις αποφάσεις της Διοικητικής Επιτροπής για το Συντονισμό των Συστημάτων Κοινωνικής Ασφάλειας
The aim of the thesis was the presentation and study of the Coordinating Regulation focusing on pension protection. Therefore, the systematic analysis of the Coordinating Regulation and the outline of the changes that have occurred in the new Coordination Regulation 883/04, in comparison with the previous (old Regulation 1408/71) took place in order to capture the social protection provided, any existing gaps, as well as the application of the coordination rules in general and particularly in relation to pensions. Having the general provisions (Title I) as a starting point, the rules for determining the applicable legislation (Title II) are the next to be examined, and then all the special provisions relating to pensions and pensioners (Title III) are illustrated on a critical basis. The multifarious issues arising from the application of Coordination Regulation are analyzed in depth. The presentation of the coordination rules through the inevitable comparison between the old and the new regulation is enriched by the relevant literature, the case law of the Court of EU, studies of the European institutions, and the Administrative Commission’s decisions for the Coordination of Social Security Systems.
