La présente thèse de doctorat traite en profondeur du problème doctrinal de « L’ Analyse du DNA dans le droit procédural grec et européen ». Ainsi, l’objectif principal de ce livre spécifique est la compréhension du concept scientifique du DNA, l’importance de l’analyse du DNA pour l’ensemble de la procédure pénale, l’approche critique des aspects importants relatifs à l’analyse du DNA dans le droit procédural grec et européen, la comparaison entre le Code de procédure pénale grec et différents systèmes juridiques dans ce domaine et la conclusion de conclusions générales sur cette question importante, mais aussi d’autres problèmes importants sont examinés en détail dans ce livre. En outre, des problèmes jurisprudentiels et théoriques critiques sont détectés, qui concernent principalement les conditions de réalisation de l’analyse du DNA, les graves dangers qui se cachent sur les droits fondamentaux et les libertés individuelles, mais aussi de nombreuses autres questions cruciales.
H παρούσα διδακτορική διατριβή ασχολείται εις βάθος με τh δογματική προβληματική της «Ανάλυσης DNA στο ελληνικό και ευρωπαϊκό δικονομικό δίκαιο». Έτσι, πρωταρχικός στόχος του συγκεκριμένου βιβλίου είναι η κατανόηση της επιστημονικής έννοιας του DNA, της σημασίας της Ανάλυσης DNA για το σύνολο της ποινικής διαδικασίας, η κριτική προσέγγιση σημαντικών πτυχών που σχετίζονται με την Ανάλυση DNA στο Ελληνικό και Ευρωπαϊκό Δικονομικό Δίκαιο, η σύγκριση μεταξύ του Ελληνικού Ποινικού Δικονομικού Δικαίου και των διαφορετικών νομικών συστημάτων όσον αφορά αυτό το πεδίο, και η εξαγωγή ορισμένων γενικότερων συμπερασμάτων σχετικά με αυτό το πολύ σημαντικό ζήτημα, αλλά και άλλα σημαντικά προβλήματα εξετάζονται λεπτομερώς σε αυτό το βιβλίο. Επιπλέον, εντοπίζονται θεμελιώδη νομολογιακά και θεωρητικά ζητήματα, τα οποία αφορούν πρωτίστως τις προϋποθέσεις διεξαγωγής της ανάλυσης DNA, τους σοβαρούς κινδύνους που ελλοχεύουν για τα θεμελιώδη δικαιώματα και τις ατομικές ελευθερίες, αλλά και πολλά άλλα κρίσιμα ζητήματα.
The present doctoral thesis deals in depth with the doctrinal problem of ‘The DNA Analysis in the Greek and the European Procedural Law’. Thus, the primary aim of this specific book is the understanding of the scientific concept of DNA, the importance of DNA Analysis for the entire criminal proceedings, the critical approach of significant aspects relating to the DNA Analysis in the Greek and the European Procedural Law, the comparison between the Greek Criminal Procedure Law and different legal systems regarding this field and drawing some general conclusions about this significant issue, but also other important problems are examined in detail in this book. In addition, critical jurisprudential and theoretical problems are detected, which concern primarily the conditions of conducting DNA Analysis, the serious dangers that lurk on fundamental rights and individual freedoms, but also many other crucial issues.
