The present dissertation, adopts the opinion that in the administration of ecclesiastical justice the teaching of the objective/external conditions of punishability of Common Criminal Law is applicable for the formation of the canonical theory of objective/external conditions of canonical punishability, since similar cases with analogous characteristics to those defined by Common Criminal Law can be found in the Holy Canons too. That is as long as the canonical theory concerning the objective/external conditions of punishability does not unquestioningly adopt the secular criminal theory, instead it diverges from it, where necessary, in order to align with the inherent distinctions of the ecclesiastical justice compared to the secular justice, as well as with the consequent canonical doctrines in relation to those of Common Criminal Law.
Η παρούσα διατριβή υιοθετεί την άποψη ότι κατά την απονομή της εκκλησιαστικής δικαιοσύνης χωρεί η εφαρμογή της διδασκαλίας των εξωτερικών όρων του αξιοποίνου του κοινού ποινικού δικαίου για τη διαμόρφωση της κανονικής θεωρίας των εξωτερικών όρων του κανονικού αξιοποίνου, καθώς στους ιερούς Κανόνες εντοπίζονται αντίστοιχες περιπτώσεις με όμοια χαρακτηριστικά με αυτά που ορίζει το κοινό ποινικό δίκαιο, αρκεί η κανονική θεωρία περί εξωτερικών όρων του αξιοποίνου να μην υιοθετεί άκριτα την κοσμική ποινική θεωρία, αλλά, όπου απαιτείται να διαφοροποιείται προκειμένου να εναρμονίζεται με τις εκ φύσεως διαφοροποιήσεις της εκκλησιαστικής δικαιοσύνης σε σχέση με την κοσμική, και των συνεπαγόμενων κανονικών δογμάτων σε σχέση με τα δόγματα του κοινού ποινικού δικαίου.
